VILLAGE BOARD MEETING                                                     MAY 14, 2007

 

·        PLEDGE OF ALLEGIANCE

 

Mayor Donald Myers called the meeting to order at 6:59 p.m.  Trustees Nancy McGuerty, Gary Fickeisen, Christopher Leonard, and Gary Mulvaney were in attendance.  Also present were:  Anne Riddell - Clerk, Susan Wade – Treasurer, Lauren Langtry – Republican Register, and Barbara Adams – Warren Real Estate.

 

·        MINUTES

 

A motion was made by Trustee Mulvaney, seconded by Trustee Leonard and carried with a 4-0 vote to approve the minutes for April 23, 2007 with a change of a word “and” to “or” under “Sheriff’s Department – Closest Car Concept.”

 

A motion was made by Trustee McGuerty, seconded by Trustee Mulvaney and carried with a 4-0 vote to approve the minutes of May 9, 2007.

 

·        BILLS

 

A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the following bills.  (Trustee McGuerty abstained from bill #508 due to conflict of interest – Community Newspapers.)

 

·        TRANSFERS

 

A motion was made by Trustee Leonard, seconded by Trustee Mulvaney and carried with a 4-0 vote to approve the following transfers:

·        DEPARTMENT REPORTS

 

A motion was made by Trustee McGuerty seconded, by Trustee Leonard and carried with a 4-0 vote to approve the Treasurers Report for the month of April.

 

A motion was made by Trustee Mulvaney seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Public Works Report and the Sewer Treatment Plant Report for the month of April.

 

A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Dog Control Report for the month of April.

 

It was noted that there was no Police Report, Code Enforcement Report, or Justice Report for the month of April.

·        TOWN OF MORAVIA WATER DISTRICT

 

Each of the Trustees received a copy of a letter from the Village responding to the Town of Moravia pertaining to the Water District #1.  A motion was made by Trustee Leonard, seconded by Trustee McGuerty and carried with a 4-0 vote to authorize the Mayor to sign and send the letter.

 

Each of the Trustees also received a copy from the Town’s new attorney Earle Thurston (replacing Andrew Fusco) pertaining to issues/questions with the Town’s Water District.  Each Trustee also received a letter of response to Attorney Thurston from Village Attorney Charles Marangola.

 

Village Clerk Anne Riddell reported that she is currently setting up a meeting with Tim Buhl, Village Attorney Charles Marangola, Town Attorney Earle Thurston, Trustee Nancy McGuerty, and Mayor Donald Myers.

 

·        FIRE STATION ON MAIN STREET

 

Mayor Donald Myers reminded the Board that the parcel that the old Fire Station is on needs to be subdivided.  The fire station is currently on the same parcel as the Village Office and the Village Barn.  The Trustees reviewed the property and directed the Village Clerk to contact Bud Manzari and request a survey and to divide the property approximately 40 feet from the back of the Fire Station running parallel with Main Street.

 

Barbara Adams of Warren Real Estate presented the Board with a proposal to sell the old Fire Station.  The Board also received a written proposal from Jack Wellauer of Southco Realty.  No decision was made.

 

·        DUMP TRUCK REPAIRS

 

Trustee Leonard stated he had not received any written estimate from Stoyell on the repair of the Village’s dump truck that is still at Stoyell’s.

 

·        DUMP TRUCK SEPCIFICATIONS

 

Each of the Trustees received a copy of specifications from Jack McNerney Chevrolet for a one-ton dump truck (2-wheel drive).  After some discussion, the Board requested specifications for a 4-wheel drive one-ton dump truck from McNerney.  The Board also requested a written trade-in value for two dump trucks that the Village Department of Public Works would like to trade in towards the purchase of a 1996 GMC dump truck at D’Augustino’s.

 

·        POLICE/JUSTICE CENTER

 

Each of the Trustees received a copy of two (2) estimates for garage door openers from August of 2006 for the new Police/Justice Center.  After some discussion, a motion was made by Trustee Mulvaney, seconded by Trustee Leonard and carried by a 4-0 vote to approve the purchase of four (4) garage door openers from John Swearingen (Barn Renovations) for a total of $1,360.00.  (The second estimate was from Genson Overhead Door, Inc. for $ 1,476.00.)

 

Village Clerk Anne Riddell reported that after speaking with the USDA, the Village was advised to have the Village’s engineer, Tim Buhl, write a letter to Gudabri, Inc. requesting some repair work be done at the new Police/Justice Center.  She stated that Mr. Buhl is drafting this letter to Gudabri, Inc.

 

Each of the Trustees also received a copy of a memo from the USDA dated October 30, 2006 that the Village had not received until May 9, 2007.  The memo was from Michael Bosak of the USDA that lists the completion dates of each contractor for the Certificate of Substantial Completion.  The memo stated that there was to have been an eleventh-month inspection in March of 2007.  The Village Clerk noted that this inspection was not done because the Village was not made aware of it being needed and because of the employee turnovers at USDA Rural Development. 

 

·        LETTER OF RESIGNATION (OFFICER TABER)

 

A motion was made by Trustee Mulvaney, seconded by Trustee McGuerty and carried with a 4-0 vote to accept the letter of resignation from Police Officer James Taber effective April 17, 2007.  The Board requested a thank you letter of be sent to Officer Taber.

 

·        SHERIFF’S DEPARTMENT – CLOSEST CAR CONCEPT

 

It was reported that the there was no update.

 

·        RESCHEDULE VILLAGE BOARD MEETING (5/28/07)

 

A motion was made by Trustee Leonard, seconded by Trustee Fickeisen and carried with a 4-0 vote to reschedule the Village Board meeting for Monday, May 28, 2007 to Tuesday, May 29, 2007 at 7:00 p.m. due to the observance of Memorial Day.  (It was noted that the Village Office would also be closed Monday, May 28, 2007.)

 

·        FULLER PARK USE REQUEST

 

Each of the Trustees received a use request for the amphitheater at Fuller Park from the Moravia Elementary School Music Department for June 7, 2007.  A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the use request and waive the $25.00 fee because of it being a non-profit organization.

 

·        EMERGENCY HOME REPAIR PROGRAM APPLICATION

 

Each of the Trustees received a copy of an Emergency Home Repair Program application for Gerald and Sharon Meddaugh from Thoma Development.

 

A motion was made by Trustee Mulvaney, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Emergency Home Repair Program Application for Gerald and Sharon Meddaugh at 38 Aurora Street for an estimate of $5,825.00 plus a $450.00 commitment fee for a new roof.

 

 

 

 

·        FINGER LAKES WATER WORKS CONFERENCE

 

A motion was made by Trustee Fickeisen, seconded by Trustee Leonard and carried with a 4-0 vote to approve Mike Perkins and Bill Smith of the Department of Public Works to attend the Finger Lakes Water Works Conference on June 7, 2007 in Geneva, New York.

 

·        EMPLOYMENT APPLICATIONS

 

After receiving several employment applications for part-time laborer, a motion was made by Trustee McGuerty, seconded by Trustee Mulvaney and carried with a 4-0 vote to accept the applications and place them on file.

 

·        DISCHARGE OF MORTGAGE - SCARRY (CDBG)

 

A motion was made by Trustee Mulvaney, seconded by Trustee McGuerty and carried with a 4-0 vote to authorize the Mayor to sign the Discharge of Mortgage for Robert and Harriet Scarry for 18 Aurora Street.  They received a Community Development Block Grant Loan that had been paid in full ($8,000.00).

 

·        2007/2008 TAX WARRANT

 

A motion was made by Trustee Fickeisen, seconded by Trustee Mulvaney and carried with a 4-0 vote to authorize the Mayor to sign the Tax Warrant for 2007-2008 for the total of $247,954.10.

 

            General Fund                  233,985.00

            Delinquent Water               4,584.02

            Delinquent Sewer               9,245.08

            Lawn Mowing (unpaid)       140.00

            TOTAL                      $247,954.10

 

·        ANNUAL CONTRACTS – VFW, AMERICAN LEGION, FIRE DEPARTMENT

 

A motion was made by Trustee Mulvaney, seconded by Trustee Leonard and carried with a 4-0 vote to approve the annual contracts for the VFW, American Legion, and the Moravia Fire Department for $100.00 each.

 

·        ANNUAL AUDIT OF JUSTICE BOOKS REQUEST

 

A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to request the Village Justice Books from June Shepardson and David Wade II be brought to the Village Board meeting on June 11, 2007 for an annual audit.

 

·        CONFLICT OF INTEREST

 

The Village Clerk distributed the Annual Conflict of Interest Disclosure Forms to the Village Board and to all the employees of the Village.  The Clerk requested that the forms be completed and returned as soon as possible.

 

 

·        EMPLOYEE CARRYOVER VACATION REQUEST (PERKINS)

 

Each of the Trustees received a copy of a letter from Village employee Mike Perkins of the Department of Public Works requesting a carryover of 13.5 days vacation (in addition to the 10 days carryover allowed).  After some discussion, a motion was made by Trustee Mulvaney, seconded by Trustee Leonard and carried with a 4-0 vote to allow Mike Perkins to carryover a total of 23.5 days vacation (10 days allowed by policy and additional accumulated 13.5 days) and Bill Smith to carryover a total of 14.5 days vacation (10 days allowed by policy and additional accumulated 4.5 days).

 

·        INFORMATIONAL ITEMS

 

The Village Board of Trustees each received a copy of the following:

-         NYSDEC Notice/Flyer.

-         Cayuga County Association of Villages Agenda and Minutes. 

-         Letter from FEMA to Village.

-         Cayuga County Health Department – Septic Inspection Notice.

 

It was noted that the Board received a thank you card from the Martin Wagner family and that sympathy cards were sent to the Howard Slade family and the Ralph Rohm family.

 

Each of the Trustees received CHIPS notification ($20,224.91 balance) for roadwork reimbursement.  After some discussion, a motion was made by Trustee Mulvaney, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Mayor’s request to slurry Church Street (estimate $10,513.00) and Allen Street (estimate $2,070.00).  The Board also requested the Mayor to get estimates to have the Village Office parking lot paved.

 

The Mayor requested the Board to look at the two trees (Mott and Copley) that the Village had received requests for their removal from the property owners.  The Board will discuss whether to have the trees removed or trimmed at the next Village Board of Trustees meeting.

 

The Board requested an Executive session be held at the next Village Board of Trustees meeting to discuss the interviews that the Trustees had with the Code Enforcement applicants.

 

Trustee Mulvaney requested a Village of Moravia Police Officer be on duty for this Saturday’s Fire Department’s “Money Mania”.  He requested also contacting the Sheriff’s Department for extra officers.  The Mayor stated that he would contact Officer in Charge James Willis with this request.

 

A motion was made by Trustee Leonard, seconded by Trustee McGuerty and carried with a 4-0 vote to adjourn at 8:50 p.m.
