Mayor Donald Myers called the meeting to order at 6:59 p.m. Trustees Nancy McGuerty, Gary Fickeisen, Gary Mulvaney, and Chris Leonard were in attendance. Also present were: Anne Riddell - Clerk, Susan Wade – Treasurer, and Lauren Langtry – Republican Register.
· MINUTES
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the minutes for May 29, 2007 Special Board Meeting.

· DEPARTMENT REPORTS
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the Treasurers Report for the month of May.
A motion was made by Trustee Mulvaney, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Public Works Report and the Sewer Treatment Plant Report for the month of May.
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the Police Report for the month of April.
A motion was made by Trustee Leonard, seconded by Trustee Mulvaney and carried with a 4-0 vote to approve the Justice Report for the month of May.
A motion was made by Trustee McGuerty, seconded by Trustee Mulvaney and carried with a 4-0 vote to approve the Dog Control Report for the month of May.
It was noted that there was no Code Enforcement Report for the month of May.
· TOWN OF MORAVIA WATER DISTRICT
Each of the Trustees received a copy of the Water Service Agreement and the USDA Agreement that the Village of Moravia is proposing to the Town of Moravia. Both Agreements were faxed to the Town of Moravia Attorney Earle Thurston with a letter attached.
· FIRE STATION – MAIN STREET
Village Clerk Anne Riddell reported that Village Attorney Charles Marangola is currently reviewing the listing he received from Barbara Adams of Warren Real Estate for the old fire station on Main Street.
· DUMP TRUCK REPAIRS
Mayor Donald Myers stated that he believed that the Village should sell the dump truck that is currently at Stoyell’s for repair and the leaf truck and purchase the dump truck from D’Agustino. Trustee Leonard stated that the Village needed to address taking care of the equipment that they currently own. Mayor Myers reminded the Board that the yellow one-ton truck that the Village owns is seventeen (17) years old and believed it to look good for the age of the truck. The Board requested the Mayor to ask Mike Perkins of the Department of Public works where the leaf box for the one-ton truck was that had been made years ago.
After some discussion, a motion was made by Trustee Mulvaney, seconded by Trustee Leonard and carried with a 4-0 vote to sell both the dump truck that is at Stoyell’s and the leaf truck (approved to sell at May 29, 2007 Village Board meeting) and not replace either vehicles at this time.
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve advertising for the Village to accept sealed bids to be opened July 6, 2007 at 3:00 p.m. for the dump truck that is at Stoyell’s.
· POLICE/JUSTICE CENTER
Each of the Trustees received a copy of the letter from Engineer Tim Buhl to Gudabri, Inc. pertaining to items needing repaired at the Police/Justice Center that should be covered under warranty.
· SHERIFF’S DEPARTMENT – CLOSEST CAR CONCEPT
It was noted that there was no news from the Sheriff’s Department on this item.
· TREE TRIMMING / REMOVAL (CONGRESS)
Clerk Anne Riddell reported to the Board that Robert Copley had contacted the Village Office and stated that he was going to be removing the tree on Congress Street and that it would be a waste of the Village’s money to trim the tree on Congress Street in front of his home. Mr. Copley asked if the Village would be willing to pay ½ of the total cost of the removal of the tree as an alternative.
After some discussion, a motion was made by Trustee Mulvaney, seconded by Trustee Fickeisen and carried with a 4-0 vote to direct the Clerk to confirm last year’s estimate from J.M. General Contracting for $1,500.00 to remove the tree on Congress Street and if it was $1,500.00 to direct J.M. Morgan to remove the tree instead of trimming. (The Clerk noted that the Board had already received an estimate from J.M. General Contracting for $350.00 to have the tree trimmed and the Board approved the trimming after the Clerk had contacted each Trustee via telephone.)
· EMPLOYMENT APPLICATIONS (LABORER & CODE ENFORCEMENT)
After receiving two (2) employment applications for part-time laborer and two (2) employment applications for code enforcement officer, a motion was made by Trustee McGuerty, seconded by Trustee Mulvaney and carried with a 4-0 vote to accept and place them on file.
· ANNUAL CONTRACTS
(FINGER LAKES, YOUTH REC., SR. CITIZENS, 4 TOWN)
Each of the Trustees received a copy of the annual contracts the Village of Moravia has with Finger Lakes, Youth Recreation, Senior Citizens, and Four Town Ambulance.
A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following annual contracts:
Finger Lakes $ 225.00
Youth Recreation $ 6,000.00
Senior Citizens $ 1,500.00
It was noted that the Four Town Ambulance annual contract was held until Four Town produces an Errors and Omissions Insurance Certificate per the advice of Attorney Chuck Marangola.
· ATTORNEY RETAINER AGREEMENT (MARANGOLA)
Each of the Trustees received a copy of the Village Attorney’s Retainer Agreement in the amount of $6,250.00 per year to be paid quarterly.
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to authorize the Mayor to sign the annual Attorney Retainer Agreement with Charles Marangola.
· ANNUAL SOFTWARE SUPPORT CONTRACT (WILLIAMSON LAW)
A motion was made by Trustee Leonard, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the annual software support agreement for the tax program with Williamson Law for $300.00.
· ANNUAL AUDIT OF VILLAGE JUSTICE BOOKS
Judge June Shepardson brought in the Village Justice Books for Board review. This item was tabled until the Trustees review the Village Justice Books prior to the next regularly scheduled Village Board meeting.
· RIGHT-OF-WAY REQUEST (TIME WARNER CABLE)
Each of the Trustees received a copy of a Right-Of-Way Request the Village received via Fax from Time Warner Cable. Village Clerk Anne Riddell stated that she gave a copy also to Village Attorney Charles Marangola and he had stated that he could not advise the Village on this matter because he is also the Moravia School Attorney. (It was noted that Moravia School is planning to receive internet service through Time Warner.) The Board directed the Clerk to contact Attorney James Baker and request his advice on this Right-Of-Way.
· EAGLE SCOUTS INVITATIONS
Each of the Trustees received invitations to the Eagle Scout Awards ceremony on June 16, 2007: Kasey A. Pearsall, William L. Gaston, Jace R. Prine, and Joseph J. Campanella. There was also a request to the Village to send a letter or a certificate acknowledging them of their achievements.
Each of the Trustees received a draft copy of the letter from the Village to each of the Eagle Scouts. A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the letters be sent to each of the four (4) Eagle Scouts.
· EMPLOYEE CARRY OVER TIME 2007/2008
Each of the Trustees received a copy of the Village’s Employee Carry Over Time for 2007/2008.
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the employee carry over time for 2007/2008.
· PROPOSED Local Law #2 of 2007 (Flood)
Each of the Trustees received a copy of the proposed Local Law #2 of 2007 entitled “A Local Law to Comply With The Floodplain Management Requirements of the National Flood Insurance Program” that had been drawn up by Village Code Enforcer Michael Wellauer and Village Attorney Charles Marangola.
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to hold a Public Hearing on Monday, June 25, 2007 at 7:15 p.m.
Village Clerk Anne Riddell reported that the proposed Local Law #2 of 2007 also had to be reviewed by the Cayuga County Planning Board. Each of the Trustees received a copy of this letter that was sent from the Village to the Cayuga County Planning Board on June 7, 2007 for their review.
· DPW EMPLOYEE RESIGNATION (KRATZER)
Each of the Trustees received a copy of a letter of resignation from part-time Village employee Paul Kratzer.
A motion was made by Trustee Mulvaney, seconded by Trustee Leonard and carried with a 4-0 vote to “regretfully” accept the letter of resignation from part-time Mechanical Equipment Operator Paul Kratzer effective immediately.
· NYSEG (CUSTOMER LINE EXTENSION – SPEED RADAR SIGN)
Each of the Trustees received a copy of a letter from NYSEG pertaining to the customer line extension needed for the speed radar sign that was installed on South Main Street.
A motion was made by Trustee Leonard, seconded by Trustee McGuerty and carried with a 4-0 vote to authorize the Mayor to sign the Customer Line Extension Worksheet for $350.00.
· SEWER UNIT CHANGE REQUEST (KEMP)
Each of the Trustees received a copy of a sewer unit change request from Jason Kemp at 20 East Cayuga Street. It noted that there was no longer an apartment in this home and is currently paying two (2) sewer unit charges. Mr. Kemp requested it to be changed to one (1) unit.
The Board directed the Village Clerk to request Code Enforcer Michael Wellauer to verify that 20 East Cayuga Street is a one family home.
· INFORMATIONAL ITEMS
The Village Board of Trustees each received a copy of the following:
- Letter from Village Board to Moravia Police Officer Crehan (leave – National Guard).
- Association of Villages of Cayuga County Agenda (6/19/07).
- Cayuga County Legislature Special Meeting Notice (6/13/07).
- Notice of 2006 In Lieu of Tax Payments (Kinney Drugs) $196.69.
It was noted that thank you notes were sent to Jim Newhart and the Moravia Garden Club for the flowers on Main Street.
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to enter executive session at 8:09 p.m. to discuss personnel.
A motion was made by Trustee Fickeisen, seconded by Trustee Leonard and carried with a 4-0 vote to exit executive session at 8:34 p.m.
A motion was made by Trustee Fickeisen, seconded by Trustee Leonard and carried with a 4-0 vote to hire Ezekiel Phoenix as part-time temporary Mechanical Equipment Operator at $9.25 with a probationary period of three (3) months effective immediately.
A motion was made by Trustee McGuerty seconded by Trustee Mulvaney and carried with a 4-0 vote to adjourn at 8:40 p.m.
