VILLAGE BOARD MEETING                                                     JUNE 25, 2007

 

·        PLEDGE OF ALLEGIANCE

 

Mayor Donald Myers called the meeting to order at 7:00 p.m.  Trustees Nancy McGuerty, Gary Fickeisen, Gary Mulvaney, and Chris Leonard were in attendance.  Also present were:  Anne Riddell - Clerk, Susan Wade – Treasurer, Officer in Charge James Willis, and Lauren Langtry – Republican Register.

 

·        MINUTES

 

A motion was made by Trustee Leonard, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the minutes for June 20, 2007 Special Board Meeting.

 

A motion was made by Trustee Mulvaney, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the minutes for June 22, 2007 Board Meeting.

 

·        BILLS

 

A motion was made by Trustee Leonard, seconded by Trustee Mulvaney and carried with a 4-0 vote to approve the following bills.  (Trustee McGuerty abstained from bill #14 due to conflict of interest – Community Newspapers.)

 

·        DEPARTMENT REPORTS

 

A motion was made by Trustee Mulvaney, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Police Report for the month of May.

 

It was noted there was no Code Enforcement Report for the month of May.

 

·        TOWN OF MORAVIA WATER DISTRICT

 

Trustee McGuerty reported that she had gone to the Town of Moravia’s Board meeting on June 20, 2007 and that the Town Supervisor Gary Hatfield stated that they had received the Village’s contract for the Water District.

 

·        FIRE STATION – MAIN STREET

 

The Clerk noted that Village Attorney Chuck Marangola is reviewing the material he received from Barbara Adams of Warren Real Estate on the possible listing of the Fire Station on Main Street.

 

·        POLICE/JUSTICE CENTER

 

It was noted that there was no news from Engineer Tim Buhl or from Gudabri, Inc. on this item.

 

Trustee Mulvaney reported that Cayuga County Sheriff David Gould had contacted him and that the Sheriff’s Department would like to move into part of the Village of Moravia’s Police Station on Monday, July 2, 2007.  The Sheriff invited the Mayor and the Trustees to the opening on July 2, 2007 at 3:00 p.m. for their first day of occupancy.

A purchase order was on the table for a flagpole for the Police/Justice center for $939.80.  Village Treasurer Susan Wade stated that the Village might be able to get a flagpole for less.

 

A motion was made by Trustee Mulvaney, seconded by Trustee Leonard and carried with a 4-0 vote to approve purchasing a flagpole for the new Police/Justice Center up to $939.80.

 

·        SHERIFF’S DEPARTMENT – CLOSEST CAR CONCEPT

 

It was noted that there was no news from the Sheriff’s Department on this item.

 

·        TREE TRIMMING / REMOVAL (CONGRESS)

 

The Clerk reported that she had contacted John Morgan of J.M. Contracting the morning after the last Village Board meeting and left him a message stating that the Board wanted to verify the last estimate of $1,500.00 Mr. Morgan gave for removal of the tree on Congress Street.  Mr. Morgan called the Village Office back and stated that the tree on Congress Street had already been trimmed.  The Board tabled this item for the time being since the Village had already paid $350.00 for trimming.

 

·        ANNUAL CONTRACT – FOUR TOWN AMBULANCE

 

The Clerk reported that the Village had received an “Errors and Omissions” Policy per the request of Village Attorney Charles Marangola.

 

A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the contract for 2007/2008 with Four Town Ambulance for $5,000.00.

 

·        ANNUAL AUDIT OF VILLAGE JUSTICE BOOKS

 

Trustee McGuerty stated that she had an appointment with Judge Shepardson on Tuesday, June 26, 2007 to review the justice books and requested this item be tabled until the next Village Board meeting.  This item was tabled.

 

·        RIGHT-OF-WAY REQUEST (TIME WARNER CABLE)

 

The Clerk reported that Attorney James Baker agreed to review the Right-of-Way request that the Village had received from Time Warner.  Mr. Baker requested and received a copy of the franchise agreement the Village currently has with Ray Dyer of Southern Cayuga County Cablevision.

 

·        PUBLIC HEARING – LOCAL LAW #2 OF 2007 – FLOOD

 

Each of the Trustees received a copy of a letter from the Cayuga County Planning Board stating that there was no comment “since it appears to have no intermunicpal concerns and to be of local concern only.

 

A motion was made by Trustee Leonard, seconded by Trustee McGuerty and carried with a 4-0 vote to open the public hearing at 7:13 p.m. for Local Law #2 of 2007 entitled “A Local Law to Comply With The Floodplain Management Requirements of the National Flood Insurance Program.”

 

The Mayor asked if there were any questions or comments.  Trustee McGuerty requested that the Board be updated in the future as to the status of Cayuga County Planning Department assisting the Village in disputing the revised map by FEMA.  Village Clerk Anne Riddell stated that she would keep the Board updated on this item.

 

A motion was made by Trustee McGuerty, seconded by Trustee Mulvaney and carried with a 4-0 vote to close the public hearing at 7:34 p.m.

 

A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to adopt Local Law #2 of 2007 entitled “A Local Law to Comply With The Floodplain Management Requirements of the National Flood Insurance Program.”

 

·        SEVEN VALLEY PROPOSAL (CENTRAL AND PARK STREET)

 

Each of the Trustees received a proposal from 7 Valley Paving for $2,455.00 to patch the end of Central Street where there had been a water leak, to pave a portion of the Village parking lot for Handicap parking, and repair the area on the corner of Park and Congress Street where the culvert had been repaired.

 

A motion was made by Trustee McGuerty, seconded by Trustee Mulvaney and carried with a 4-0 vote to approve the 7 Valley proposal for $2,455.00.

 

After some discussion, the Board requested the Mayor to also get a proposal to repair Smith Street and to talk with the State about the corner of Central Street and Route 38 (Main Street) that is consistently in need of repair where the two roads intersect.

 

·        VILLAGE EQUIPMENT AND LABOR RATES 2007/2008

 

A motion was made Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following village equipment and labor rates:  $ 26.25/hour - Labor, $ 57.75/hour - Dump Truck, $ 63.00/hour - Back Hoe, $21.00/hour – Lawn Mower, and the addition of $31.50/hour – Plow/Sander.  The Mayor noted that there was a 5% increase.

 

·        DISCHARGE OF MORTGAGE (SHENK)

 

Each of the Trustees received a copy of a Discharge of Mortgage for Zachary and Laura Shenk for the property located at 66-68 Grove Street.  Treasurer Susan Wade stated that the Village had received payment in full for the Community Development Block Grant.

A motion was made by Trustee Mulvaney, seconded by Trustee Leonard and carried with a 4-0 vote to authorize the Mayor to sign the Discharge of Mortgage for Zachary and Laura Shenk for 66-68 Grove Street.

 

·        ANNUAL FINANCIAL REPORT 2006/2007

 

Village Treasurer Susan Wade presented the Board with the Village of Moravia Annual Financial Report for 2006/2007.

 

A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the Annual Financial Report for 2006/2007.

 

·        ANNUAL SOFTWARE SUPPORT CONTRACTS (WILLIAMSON LAW)

 

A motion was made by Trustee Leonard, seconded by Trustee Mulvaney and carried with a 4-0 vote to approve the annual software support agreements for water/sewer support and municipal accounting support with Williamson Law for a total of $1,450.00.

 

·        COPIER MAINTENANCE AGREEMENT

 

A motion was made by Trustee Mulvaney, seconded by Trustee Fickeisen and carried with a 4-0 vote to authorize the maintenance agreement with Copier Products Sales & Service, Inc. at the cost of $500.00 per year.

 

·        PROCLAMATION (MAYOR MYERS)

 

At the end of the meeting Acting Mayor Gary Fickeisen read the following proclamation aloud:

 

WHEREAS, the Village of Moravia Board of Trustees would like to recognize and thank Donald H. Myers for his service to the Village of Moravia, as Mayor of the Village for the years:

 

July 1967-1973

July 1977-1979

July 1995-2007

 

and as Village Trustee of the Village of Moravia for the years:

 

July 1976-1977

July 1993-1995

 

AND WHEREAS, through the leadership, foresight, and dedication of Donald H. Myers, the Village of Moravia completed many projects that helped the residents of the Village and made the Village of Moravia a better place to live, including the following:

 

 

NOW THEREFORE BE IT RESOLVED THAT, the Village of Moravia Board of Trustees, hereby recognizes Donald H. Myers for his service and commitment to the Village of Moravia, and also extend their thanks, gratitude, and appreciation to Mayor Donald H. Myers for more than 23 years of faithful service and dedication to the Village of Moravia and its residents.

·        INFORMATIONAL ITEMS

 

The Village Board of Trustees each received a copy of the following:

-         Letter from Village to Paul Krazter (resignation).

-         Cayuga County Legislature Agenda and Resolution List (06/26/07).

 

A thank you note was on the table for Trustee McGuerty from the Community Preservation Committee for welcoming the Cayuga County Visitor’s Office tour recently.

 

A motion was made by Trustee Leonard, seconded by Trustee McGuerty and carried with a 4-0 vote to enter executive session at 7:59 p.m. to discuss personnel.

 

A motion was made by Trustee McGuerty, seconded by Trustee Mulvaney and carried with a 4-0 vote to exit executive session at 8:21 p.m.

 

A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to appoint Jerry VeVone as part-time Code Enforcement Officer for the Village of Moravia effective July 1, 2007 at the rate of $5,500.00 per year.

 

A motion was made by Trustee Fickeisen, seconded by Trustee Leonard and carried with a 4-0 vote to adjourn at 8:24 p.m.
