· PLEDGE OF ALLEGIANCE
Mayor Gary Mulvaney called the meeting to order at 6:59 p.m. Trustees Nancy McGuerty, Gary Fickeisen, Chris Leonard, and Anthony Peppe were in attendance. Also present were: Anne Riddell – Clerk and Susan Wade – Treasurer. Paul Levesque and Paul Levesque, Jr. entered at 7:10 p.m.
· PUBLIC TO BE HEARD
Mayor Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke.
· MINUTES
A motion was made by Trustee Peppe, seconded by Trustee Leonard and carried with a 4-0 vote to approve the minutes for September 22, 2008 Village Board Meeting.
· BILLS
A motion was made by Trustee Leonard, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from bill #152 due to conflict of interest.)
· DEPARTMENT REPORTS
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the Treasurer’s Report for the month of September.
A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Public Works Report for the month of September.
A motion was made by Trustee Leonard, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of September.
A motion was made by Trustee Fickeisen, seconded by Trustee Leonard and carried with a 4-0 vote to approve the Code Enforcement Report for the month of September.
A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Dog Control Report for the month of September.
It was noted that there was no Police Report or Justice Report for the month of September.
· PUBLIC TO BE HEARD
Paul Levesque, Jr. addressed the Board. Paul stated that he is working on his Eagle Scout project which entails creating a handicap “zone” in front of the Catholic Church on Grove Street.
After some discussion about the project, a motion was made by Trustee Leonard, seconded by Trustee Fickeisen and carried with a 4-0 vote permitting Paul Levesque, Jr. to create a “handicap zone” directly in front of the Catholic Church on Grove Street.
The Board thanked Paul for coming and told him that they believed it to be a very good project.
· TOWN OF MORAVIA WATER DISTRICT
They Mayor stated that there was no update on the proposed Town of Moravia Water District.
· ASBESTOS REMOVAL – BARN ADJACENT TO FULLER PARK
Mayor Mulvaney stated that there was no update. This item was tabled until the next regularly scheduled Board meeting.
· LETTER OF REQUEST (INDIAN MOUND CEMETERY)
Mayor Mulvaney noted that the Indian Mound Cemetery Celebration was scheduled for October 18, 2008 and could be removed from the agenda. Mayor Mulvaney stated that there would be police assistance for traffic control on Route 38A that day.
· FEMA – CRS DISCOUNT
Village Clerk Anne Riddell stated that there was no news from FEMA and would keep the Board updated.
· CURBING IN THE VILLAGE
Village Clerk Anne Riddell reported that the Village of Moravia has a carry-over balance for 2009 in the amount of $20,704.01 in CHIPS, with a projected disbursement of $15,473.70, totaling $36,177.71 for 2009. It was noted that the monies are not guaranteed funds, and may not always be available. There was discussion about curbing for the spring of 2009 on Main Street between the Post Office and the School and Smith Street. Mayor Mulvaney stated that he would speak to Mike Perkins of the Department of Public Works to contact Bruce Hazen for an estimate. Village Clerk Anne Riddell also reminded the Board that any curbing done on Main Street would need to be coordinated with the NYSDOT, which could take up to a year to process, according to the NYSDOT.
· QUARTERLY FAIR HOUSING PUBLIC NOTICE
A motion was made by Trustee Leonard, seconded by Trustee Peppe and carried with a 4-0 vote to approve the advertising of the quarterly Fair Housing Public Notice.
· LETTER FROM FOUR-TOWN FIRST AID SQUAD
Each of the Trustees received a copy of a letter from Four-Town First Aid Squad addressed to Mayor Mulvaney requesting the Village of Moravia remit $3,215.00 for the Worker’s Compensation Insurance that was the Town of Moravia’s portion that Four-Town was unable to collect.
A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to pay Four-Town First Aid Squad $3,215.00 for the Town of Moravia’s portion of the Worker’s Compensation Insurance.
A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to send a letter to the Town of Moravia notifying them that the Village of Moravia paid for their portion of the Worker’s Compensation Insurance and requesting that they include the $3,215.00 plus the amount due for 2009 in their 2009 budget, so that the Village can get reimbursed from the Town.
· LETTER FROM TOWN OF MORAVIA – SMITH STREET BRIDGE
Each of the Trustees received a letter from Town Councilman Terry Baxter requesting a sewer adjustment for Village property owner Janelle Coolbaugh due to the contractor’s of the Smith Street bridge using her outdoor water faucet during the construction and that the water did not pass through the sewer system.
After some discussion, a motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to average the sewer bill for Janelle Coolbaugh for her property located at 20 Smith Street.
· BANNERS FOR MAIN STREET BRIDGE
Village Clerk Anne Riddell reported that business owner, Roger Phillips, is currently looking into having the four banners for the Main Street Bridge re-done, courtesy of the Moravia-Locke Chamber of Commerce.
· AUTHORIZATION TO REVIEW VILLAGE’S UTILITY ACCOUNTS
Treasurer Susan Wade requested authorization to have the Village’s utility accounts reviewed by an outside firm. It was noted that the accounts were last reviewed by Troy and Banks in 1999.
A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote authorizing Treasurer Susan Wade to request Troy and Banks to review the Village’s utility accounts.
· TREE REMOVAL – VILLAGE PROPERTIES
Mayor Mulvaney reported that the Village received concerns for two (2) trees in the Village of Moravia that may need to be taken down due to safety reasons. Trustee Peppe stated that he would check with Mike Perkins in the Department of Public Works and take a look at the trees and report back to the Board.
· SURETY BOND (HIGHWAY WORK PERMIT)
A motion was made by Trustee Leonard, seconded by Trustee Peppe and carried with a 4-0 vote to authorize the Mayor to sign the Surety Bond so that the Village of Moravia can apply for the Annual Highway Work Permit with the New York State Department of Transportation. Village Clerk Anne Riddell stated that the NYSDOT required the Village to cancel the current bond and have a new one so that the dates of the bond would coincide with the annual highway work permit.
It was noted that the bond was for the same amount of $2,000.00 and that the permit allows the Village to perform work within the Highway Right-of-Way of State Route 38 and State Route 38A.
· FARMER’S MARKET REQUEST
Each of the Trustees received a copy of a letter from Kathy Eaton of the Farmer’s Market requesting the Village contact the Cayuga Correctional Facility to have a few concrete picnic tables made. The Board had the following concerns:
- How much do the tables cost?
- Where will the tables be stored during the winter?
- How heavy are the tables and how would they be moved?
The Board directed Village Clerk Anne Riddell to contact Kathy Eaton and ask the above questions and report back to the Board.
· WORKER’S COMPENSATION QUOTE
Each of the Trustees received a quote from Eastern Shore Associates for Cayuga County’s 2009 worker’s compensation. Mayor Mulvaney stated that he had contacted Dempsey Insurance that currently has the Village’s worker’s compensation and requested a quote from him. This item was tabled until the next regularly scheduled Board meeting.
· INCREASE IN SALARY (LELAND ROGERS)
Treasurer Susan Wade informed the Trustees that Village employee Leland Rogers had been working with Tom Janke in front of the High School as Crossing Guard and that this position pays more than the Crossing Guard position by the Post Office that he was previously holding.
A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to increase Leland Rogers salary to the current salary for the Crossing Guard position in front of the high school.
· SEWER REDUCTION REQUEST (HAWLEY BUILDING – ROBINSON)
Each of the Trustees received a copy of a letter from Scot Robinson, owner of the old Hawley building on Main Street, requesting the Board reduce the number of sewer units from the current five (5) to one (1) sewer unit. Mr. Robinson noted that the four apartments on the second and third floor are in major disrepair and not “rentable” at this time. The Board directed Village Clerk Anne Riddell to contact Code Enforcement Officer Rick Fritz to verify this request in writing. This item was tabled until the next regularly scheduled Board meeting.
· LETTER FROM CAYUGA COUNTY REAL PROPERTY SERVICES (ALCORN)
Each of the Trustees received a letter from Cayuga County Real Property Services to Mayor Mulvaney concerning the water and sewer accounts for 12-14 Allis Avenue (Alcorn property that was recently sold at auction).
Alan Kozlowski, Director of Real Property, requested the Village of Moravia remove the charges because Real Property was unaware of any outstanding water and sewer charges when the property sold at auction.
A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to forgive the total amount due of $1,040.93 on water/sewer accounts #21070 and #21071 for the property located at 12-14 Allis Avenue (Tax Parcel # 210.09-2-20).
The Board directed Village Clerk Anne Riddell to send a letter to Cayuga County Real Property with a copy sent to the new owner advising them of the Board’s action.
· OAK HILL WATER TANK
After reviewing the 2005 Oak Hill Road Municipal Water Distribution System Report from Weeks Engineering and replacing water tank, the Board requested a meeting with Mike Perkins of the Department of Public Works and with Chuck Weeks of Weeks Engineering. Mayor Mulvaney stated that the Village Office would notify the Trustees of the date and time of the meeting.

It was noted that there was a copy of the Cayuga-Owasco Lakes Historical Society newsletter on the table for Board Review.
Village Clerk Anne Riddell noted that a get-well card was sent to Village Crossing Guard Dale Southwell.
Trustee Fickeisen reported a concern he received from a Keeler Avenue resident about the sharp curve behind the Village Justice Center. Trustee Fickeisen inquired if the Village should consider painting a yellow line down the center of Keeler Avenue so that cars would be more conscientious to stay on their own side of the road while going around the curve. Mayor Mulvaney noted that the Village does not paint the side streets, nor has the capability to paint lines in the roads. No action was taken at this time.
A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to enter Executive Session at 9:11 p.m. to discuss personnel.
A motion was made by Trustee Fickeisen, seconded by Trustee Leonard and carried with a 4-0 vote to exit Executive Session at 9:30 p.m.
A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to adjourn at 9:30 p.m.
