VILLAGE BOARD MEETING                                         DECEMBER 28, 2009

 

·        PLEDGE OF ALLEGIANCE

 

Mayor Gary Mulvaney called the meeting to order at 6:59 p.m.  Trustees Nancy McGuerty, Anthony Peppe, Christopher Leonard, and Gary Fickeisen were in attendance.  Also present were:  Anne Riddell – Clerk, Susan Wade – Treasurer, and Melinda Bourque – Republican Register.

 

·        PUBLIC TO BE HEARD

 

Mayor Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda.  No one spoke.

 

·        MINUTES

 

A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the minutes for the December 14, 2009 Village Board Meeting.

 

·        BILLS

 

A motion was made by Trustee Leonard, seconded by Trustee Peppe and carried with a 4-0 vote to approve the following bills.

 

·        DEPARTMENT REPORTS

 

A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Dog Control Report for the month of November.

 

·        OLD FIRE STATION (MAIN STREET)

 

Mayor Mulvaney reported that the Mueller’s were waiting for their attorney to review the signed purchase offer papers.

 

·        OAK HILL WATER TANK

 

Mayor Mulvaney reported that Le-Claire Fleming tested the water and the results were positive.  He also reported that they were starting to hook up the new tanks today.

 

·        SPAULDING WATER BILL

 

Mayor Mulvaney reported that there was no news on the delinquent water bill for Don Spaulding for his Rockefeller Road property.

 

·        WEST AVENUE STORM WATER PIPING PROJECT

 

Each of the Trustees received a copy of a letter from Assemblyman Brian Kolb in response to the Village’s letter requesting financial assistance for the West Avenue Storm Water Piping Project.  Assemblyman Kolb stated that there are not enough financial resources for this project through the state.

·        CODE OF ETHICS POLICY

 

Village Clerk Anne Riddell reported that after discussing the Board’s questions with Village Attorney Charles Marangola, that Mr. Marangola confirmed that on Item #6 “Gifts”, it is $75.00 per employee/official per year.  Also, upon reading the Attorney General’s Opinion from 1998, “A village justice may serve as his or her own clerk.”  Mr. Marangola advised the Board to remove “a” from Item #12 “Incompatible Positions – Judicial Standards” which read, holding more than one position with the Village when one is subordinate to the other.

 

Village Clerk Anne Riddell distributed a final copy of the Code of Ethics to the Board with the exclusion of “a” from Item #12.

 

A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the Village of Moravia Code of Ethics.

 

·        WORKPLACE VIOLENCE PREVENTION PROGRAM

 

Mayor Mulvaney stated that a “Designated Contact Person” needed to be listed on the recently approved Village of Moravia Workplace Violence Prevention Policy & Incident Reporting.

 

After some discussion, a motion was made by Trustee Leonard, seconded by Trustee Peppe and carried with a 4-0 vote to name both the Village Clerk and/or the Mayor as the Designated Contact Person to the Village of Moravia Workplace Violence Prevention Policy & Incident Reporting.

 

·        CENSUS TESTING SITE

 

Village Clerk Anne Riddell requested permission to allow the U.S. Census Bureau to use the Village Board Room for testing for employment applications on January 6, 13, 20, and 27, 2010.

 

A motion was made by Trustee McGuerty, seconded by Trustee Leonard and carried with a 4-0 vote to approve the US Census Bureau to use the Village Board Room on January 6, 13, 20, and 27, 2010.

 

·        EMPLOYMENT APPLICATION (O’NEIL)

 

An employment application from Nicholas O’Neil was on the table for Board review.

 

A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to accept the employment application from Nicholas O’Neil and place on file.

 

·        TREE REMOVAL ESTIMATE (JM GENERAL CONTRACTING)

 

Each of the Trustees received a copy of an estimate from JM General Contracting to either trim or remove two (2) trees at 187 North Main Street that the Mayor stated he had received a letter of complaint on the trees being dangerous.

 

Mayor Mulvaney stated that the Department of Public Works has requested a second estimate from another contractor and is waiting to receive it.  This item was tabled.

 

·        THANK YOU FOR BANNERS (CHAMBER & ROGER PHILLIPS)

 

A motion was made by Trustee Leonard, seconded by Trustee McGuerty and carried with a 4-0 vote to authorize Village Clerk Anne Riddell to send a thank you letter to the Moravia/Locke Chamber of Commerce and Roger Phillips for the new Moravia Banners that they replaced on the Main Street Bridge.

 

·        NOTICE OF INTENT TO MODIFY VILLAGE OF MORAVIS SPDES PERMIT

 

After an explanation from Sewer Treatment Plant Operator Dick Phoenix, a motion was made by Trustee Leonard, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following public notice for the Republican Register on December 30, 2009 per the direction of the New York State Department of Environmental Conservation Department:

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002 2756, DEC Identification #:7-0542-00004/00001), the Village of Moravia pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The most significant proposed changes to the permit are as follows: The ammonia limit for the months of November through May are established at 7.4 mg/l as a 30 day average. Previously, this parameter was “monitor” only by the permittee without an existing limit. This new limit is based on ammonia toxicity standards that were revised in the early 1990's and after the initial

permit limits were established for this facility. All other limits are protective of water quality and have not been changed. All permit changes and existing permit requirements are drafted to be protective of water quality in the Owasco Inlet.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

 

State Environmental Quality Review (SEQR) Determination

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination

The proposed activity is not subject to review in accordance with SHPA. The permit type

is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

·        REMOVAL OF PART-TIME VILLAGE EMPLOYEE FROM PAYROLL (PURDY)

 

After some discussion, a motion was made by Trustee Fickeisen, seconded by Trustee Leonard and carried with a 4-0 vote to approve removing Part-Time Mechanical Equipment Operator Ryan Purdy from the Village of Moravia Payroll, due to the fact that he has not worked for the Village of Moravia since March 2008 and to send him a letter to this effect.

A motion was made by Trustee Leonard, seconded by Trustee Peppe and carried with a 4-0 vote to adjourn at 7:37 p.m.
